ASHWAUBENON – Once a new Dave & Buster’s restaurant and arcade opens next year in the Bay Park Square, it will be assured of being able to obtain a Class B Beer/Class B Liquor License.

The village board agreed Tuesday, Aug. 27, to grant a license, either as an exception to Ashwaubenon’s quota for those licenses or as a regular liquor license if the quota is not yet filled.

Village Clerk/Treasurer Patrick Moynihan Jr. said Dave & Buster’s, which will be located in the former Younkers Furniture Gallery now being renovated, will have a seating capacity of 329 and exceeds the minimum of 300 to be exempted from the quota under state statutes.

“Seeing that they don’t have a premise as of yet, we wanted to provide them, if you will, with peace of mind in a resolution form that the village board will be granting them a license, once they are open for next May, perhaps,” Moynihan said. “We did this in the past (for another business)… One way or the other, (Dave & Buster’s will get a license.)”

Moynihan also noted the municipal code states a license issued must be utilized within 90 days, or the applicant may request additional time to use the license due to construction or remodeling, so a resolution approving authorization of a license was presented.

The plans provided to the village show Dave & Buster’s will occupy around 27,000 square feet in the mall with approximately another 5,500 square feet adjacent to it available for retail use.
